Montessori Lernwelt – General Terms and Conditions (GTC)

§ 1 Scope and Provider

1.1 These General Terms and Conditions (GTC) apply to all orders placed through the Montessori Lernwelt online shop (hereinafter referred to as the “provider”).

1.2 The customer's conflicting terms and conditions are not accepted unless their application is expressly approved in writing.

1.3 The range of goods is intended exclusively for consumers as defined in § 13 BGB. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their commercial or self-employed professional activity.

§ 2 Formation of Contract

2.1 The products displayed in the online shop do not constitute a legally binding offer, but an invitation to place an order.

2.2 By clicking the “Buy Now” button, the customer submits a binding offer to purchase.

2.3 The provider accepts the order either by sending an order confirmation by email or by delivering the goods within 2 business days.

2.4 The customer receives an order confirmation by email immediately after placing the order. Orders are generally processed and shipped within 1–3 business days after payment is received.

2.5 Cancellations are only possible within 24 hours of placing the order. After that, the regular processing and shipping process begins, and the cancellation can no longer be taken into account.

§ 3 Prices and Taxes

3.1 All prices on the website are listed as net prices, excluding taxes. The applicable value-added tax is added and displayed during checkout.

3.2 The prices applicable at the time of ordering shall apply.

§ 4 Shipping Costs and Delivery

4.1 Delivery is available to the countries that can be selected in the online shop.

4.2 No shipping costs are charged for any deliveries.

4.3 If not all ordered products are available, the provider is entitled to make partial deliveries, insofar as this is reasonable for the customer.

4.4 Delivery usually takes 7–15 business days, depending on the destination country.

§ 5 Payment Terms

5.1 The following payment methods are available in the online shop:

  • Credit card (Visa, Mastercard, American Express)
  • PayPal
  • Shop Pay
  • Google Pay
  • Apple Pay

5.2 Payment is due immediately upon conclusion of the contract.

§ 6 Right of Withdrawal

6.1 Consumers have a statutory 14-day right of withdrawal.

6.2 Details are set out in the cancellation policy, which is available on a separate page.

6.3 Returns are only possible after receipt of the goods and must be made in accordance with the cancellation policy.

6.4 Before placing an order, the customer must ensure that all details (delivery address, product variants, etc.) are correct to avoid unnecessary returns and delays.

§ 7 Retention of Title

The goods remain the property of the provider until paid for in full.

§ 8 Warranty

Statutory rights regarding liability for defects apply.

§ 9 Liability

9.1 The provider is liable without limitation in cases of intent and gross negligence.

9.2 In cases of ordinary negligence, the provider is liable only for damages resulting from the breach of material contractual obligations (cardinal obligations), limited to foreseeable damages.

9.3 Liability for injury to life, limb, or health remains unaffected.

§ 10 Online Dispute Resolution

The EU Commission provides a platform for online dispute resolution (ODR):

The provider is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final Provisions

11.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

11.2 If individual provisions of these GTC are invalid, the validity of the remaining provisions shall remain unaffected.
